Acceptance of terms

These Terms of Use ("Terms") form a binding agreement between you and ZelleApply ("ZelleApply", "we", "us", "our") governing your access to and use of zelleapply.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not access or use the Site.

Eligibility

You must be at least 18 years old and a resident of the United States to submit any application form on the Site. The Site is directed primarily at a U.S. audience. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Editorial nature of the Site

We are an independent editorial website that publishes informational articles, comparisons and reviews about Zelle® and U.S. digital payment services. We are not a bank, lender, broker, financial advisor or regulated financial institution. Nothing on the Site constitutes financial, legal, tax or investment advice. Always consult a qualified professional before making a financial decision.

ZelleApply is not affiliated with, endorsed by, or sponsored by Zelle® or Early Warning Services, LLC. "Zelle" and the Zelle marks are the property of their respective owners and are used on this Site only for descriptive and comparison purposes under the doctrine of nominative fair use.

Accuracy of information

We strive for accuracy and update our content when the underlying products change, but we make no representation or warranty, express or implied, as to the accuracy, completeness or timeliness of any information on the Site. Bank limits, fees, rates and policies can change without notice. Always verify current terms directly with the provider before taking any action.

Representative APRs, loan amounts, repayment terms and fees for third-party cash advance and personal loan products featured on the Site are set by each individual lender and are shown for illustrative purposes only. They are not an offer of credit and do not represent any specific product you may be offered.

Affiliate relationships

Permitted use

You may view, print and download content from the Site for personal, non-commercial use. You may share links to Site pages via standard web mechanisms (social sharing, email, messaging).

Prohibited uses

  • Republish, scrape, mirror, syndicate or create derivative works from Site content without prior written consent;
  • Use the Site, its content or data for commercial purposes other than placing your own application through our form;
  • Use any automated means (bots, scrapers, crawlers) to access the Site other than well-known search engine or AI assistant crawlers accessed in a manner consistent with our robots.txt;

  • Interfere with the Site's operation, overload its infrastructure, or disrupt other users;
  • Impersonate any person or entity, including ZelleApply or its editorial team;
  • Transmit malware, spam, chain letters, unsolicited commercial communications or any other prohibited content through any Site function;
  • Use the Site in violation of any applicable law, regulation or third-party right;
  • Reverse engineer, decompile or attempt to extract source code from any Site software.

User submissions

Any information you submit through forms or email is governed by our Privacy Policy. By submitting a loan or account application through the Site, you authorize us to share your information with our matching partner (APIdiamond.com) for the purpose of matching you with offers.

If you send us feedback, suggestions, corrections or other communications, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use that content in any medium for any purpose, including Site improvement, editorial coverage and marketing — without compensation to you. You confirm that your submission does not infringe any third party's rights.

Do not send confidential information through any Site form or email unless we expressly request it.

Third-party links and services

The Site contains links to third-party websites and services, including financial product providers. We do not control and are not responsible for the content, terms, privacy practices or availability of third parties. Any transaction you enter into with a third party is solely between you and that third party.

Intellectual property

All content on the Site — including text, graphics, logos, images, software, and the overall look and feel — is owned by us or our licensors and is protected by U.S. and international copyright, trademark and other intellectual property laws. All rights reserved.

The ZelleApply name and brand are our trademarks. Third-party trademarks (including "Zelle®", "Venmo", "Cash App", "PayPal" and the names of banks) are the property of their respective owners and are used on the Site only for identification, comparison or editorial purposes under nominative fair use.

DMCA notice and takedown

If you believe content on the Site infringes your copyright, you may send a notice meeting the requirements of the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) to our Designated Copyright Agent at:

Your notice must include: your physical or electronic signature; identification of the copyrighted work; identification of the allegedly infringing material and its URL on the Site; your contact information; a statement of good-faith belief that use is not authorized; and a statement under penalty of perjury that the notice is accurate and you are authorized to act. Misrepresentations in a DMCA notice may subject you to liability for damages.

Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS; TO THAT EXTENT, SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZELLEAPPLY AND ITS EDITORIAL TEAM, OFFICERS, EMPLOYEES, AGENTS AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL OR OTHER INTANGIBLES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY THIRD-PARTY PRODUCT YOU REACH FROM THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; TO THAT EXTENT, SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend and hold harmless ZelleApply and its editorial team, officers, employees, agents and licensors from any claim, demand, liability, damage, loss or expense (including reasonable attorneys' fees) arising out of or relating to: your breach of these Terms; your use of the Site; your submission of content to us; your violation of any law or third-party right; or your interaction with any third-party product reached from the Site.

Dispute resolution

Before filing any formal claim, you agree to first contact us at [email protected] to attempt informal resolution. We will respond within thirty (30) days and attempt a good-faith resolution for an additional sixty (60) days.

If informal resolution fails, any dispute, claim or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring an individual action in small-claims court if the claim qualifies.

Class-action waiver. You and ZelleApply each waive the right to participate in a class action, class arbitration or consolidated proceeding to the maximum extent permitted by law. This waiver is a material term and if a court holds it unenforceable, the entire arbitration provision becomes void and both parties may litigate in court.

Opt-out right. You may opt out of the arbitration provision within thirty (30) days of first accepting these Terms by sending written notice to [email protected] with the subject "Arbitration opt-out" and your identifying information. Opting out does not affect the rest of these Terms.

Governing law and venue

These Terms are governed by the laws of the United States and the state in which we are organized, without regard to conflict-of-law principles. Any claim not subject to the arbitration provision above shall be brought exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction and venue there.

Severability and waiver

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Entire agreement

These Terms and our Privacy Policy, Affiliate Disclosure, and any other legal notices published on the Site constitute the entire agreement between you and ZelleApply concerning your use of the Site and supersede any prior agreements. These Terms are not assignable, transferable or sublicensable by you; we may assign them without restriction.

Changes to these terms

We may modify these Terms at any time by posting an updated version on this page and updating the "Last updated" date. Material changes will be communicated with at least thirty (30) days' advance notice via a prominent Site banner or email where we have your address on file. Your continued use of the Site after the effective date of any change constitutes acceptance of the revised Terms.
